This Legal Notice governs access to and use of the website https://hermet.ai (hereinafter, "the Website"), owned by ENTROPY BAY, S.L. (hereinafter, "Hermet" or "the Company").

The Website aims to provide information about Hermet's services, consisting of a telephone companionship service using artificial intelligence primarily aimed at elderly people.

Access to the Website confers the status of user (hereinafter, "the User") and implies full and unreserved acceptance of all provisions included in this Legal Notice.

The Website includes a contact form for general inquiries, as well as references to the Hermet Family mobile app (available on Google Play and coming soon to App Store) and the subscriber management dashboard. The use of these channels and applications is also subject to this Legal Notice.

3. Access and Use Conditions

3.1 Access to the Website

Access to the Website is free except for the connection costs through the telecommunications network provided by the User's contracted access provider.

3.2 User Obligations

The User agrees to:

Make lawful use of the Website, in accordance with current legislation, morality, good customs, and public order.
Not carry out illicit activities or activities contrary to good faith.
Not disseminate racist, xenophobic, pornographic content or propaganda, content that promotes terrorism, or that violates human rights.
Not cause damage to the physical and logical systems of Hermet, its suppliers, or third parties.
Not introduce or spread computer viruses or any other physical or logical systems that may cause damage.
Not attempt to access, use, and/or manipulate the data of Hermet, third-party providers, and other users.
Not reproduce, copy, distribute, transform, or modify the contents without express authorization from the owner.
Not suppress, circumvent, or manipulate the copyright and other identifying data of Hermet's rights.

3.3 Accuracy of Information

The User guarantees the authenticity and accuracy of the data communicated through the Website's forms. It is the User's sole responsibility to keep this information up to date.

4. Intellectual and Industrial Property

4.1 Ownership

All content on the Website, including but not limited to: texts, photographs, graphics, images, icons, technology, software, links, graphic design, source code, as well as its design and the intellectual and industrial property rights that may correspond to said content, are the property of ENTROPY BAY, S.L. or third parties who have authorized their use.

4.2 Trademarks

The trademarks "Hermet" and "María", as well as associated logos and graphic elements, are trademarks registered or in the process of registration by ENTROPY BAY, S.L. Their use without express authorization is prohibited.

4.3 Prohibitions

The following is expressly prohibited:

Total or partial reproduction, distribution, transformation, or public communication of the contents without express written authorization from Hermet.
Use of the contents for commercial or advertising purposes without authorization.
Extraction and/or reuse of databases.
Use of web scraping techniques or similar.

4.4 Limited Authorization

The User is only authorized to view and obtain a temporary private copy of the contents for their exclusive personal and private use, and commercial use is expressly prohibited.

5. Disclaimer of Warranties and Liability

5.1 Availability and Continuity

Hermet does not guarantee the availability and continuity of the Website's operation. When reasonably possible, prior notice will be given of interruptions.

5.2 Utility

Hermet does not guarantee that the Website will be useful for any specific activity.

5.3 Accuracy and Completeness

Hermet reserves the right to update, modify, or delete the information contained on the Website, and may even limit or deny access to such information.

Hermet excludes, within the limits established by current legislation, any liability for:

The María service provided by Hermet is a companionship service and does NOT constitute medical, psychological, or any other professional advice. It in no way replaces the care of qualified healthcare professionals.

5.6 Artificial Intelligence Transparency

María is an artificial intelligence system that makes companionship calls. At the beginning of each call, María informs the user that it is an artificial intelligence assistant, in compliance with the transparency requirements of the European Union's Artificial Intelligence Regulation (EU) 2024/1689 (AI Act).

6. Links

6.1 Links from the Website

In the event that the Website contains links or hyperlinks to other Internet sites, Hermet will not exercise any control over such sites and content. In no case will Hermet assume any responsibility for the content of any link belonging to an external website.

6.2 Links to the Website

Those who wish to establish a hyperlink between their website and the Website must comply with the following conditions:

The link will only link to the main page.
The establishment of the hyperlink does not imply any relationship between Hermet and the owner of the website.
Links from pages containing illegal, illicit, degrading, or immoral content will not be permitted.
